How to contest a parking or traffic fine in Belgium

A clear, step-by-step guide to contesting a Belgian fine: the deadlines, the right channel, what to write, and how to keep proof.

Got a fine under your windscreen or in the post? You have the right to contest it — and a sizeable share of Belgian parking fines are cancelled every year because of an error, a paid ticket that wasn't registered, or a missing legal basis. Here is the calm, reliable way to do it.

1. Identify what kind of fine you have

This matters more than anything else, because the channel and deadline change:

  • Parking retribution (redevance / retributie) — issued by a city or by parking.brussels for an unpaid or expired meter. This is a civil debt, not a criminal fine. No itsme needed to contest.
  • GAS / SAC fine — a municipal administrative sanction (e.g. parking in a forbidden spot). You contest it to the sanctioning official.
  • Penal fine — speeding, red light, issued by the police. This is criminal and the stakes are higher.

2. Respect the deadline

Deadlines are short and strict. parking.brussels gives you 10 days; most other Brussels municipalities give 15; GAS and penal fines usually give 15–30 days. Missing the deadline almost always means losing your right to contest, so act the day you receive the fine. See our deadlines guide.

3. Build your argument

A good contestation is specific and factual. Strong grounds include: you had a valid ticket or resident permit, the signage was missing or contradictory, the plate or vehicle was misread, you had already paid, or the notice has a formal defect. See valid grounds.

4. Send it through a channel that leaves proof

Whatever you do, keep evidence that you sent it on time. Registered post (lettre recommandée / aangetekende brief) is accepted by every agency and gives you a dated receipt — it is the safest channel. 5. Keep paying attention

Sending a contestation does not always freeze the debt. For parking retributions, paying within the deadline suspends recovery costs and is refunded if you win — so a contested-but-paid fine is often the lowest-risk path. Watch your inbox and letterbox for the agency's reasoned reply.
